General Terms and Conditions of Use & Privacy Policy
Please note that the following agreement was originally written in Portuguese. In the event of any conflict or inconsistency between the terms presented herein and the original text, the text in Portuguese will take precedence over all translations.
Definition
The Art Boulevard, property of CECT - Consultora de Educación, Cultura y Tecnología Ltd., is a network of artists that offers a platform of creative opportunities upon which young artists can engage and collaborate with Art Lovers, the name given to arts venues and cultural organisations for the purpose of this Project. To that end, the platform offers, among other functionalities, the following features:
- Online profiles and accounts for Artists and Art Lovers that require individual user authentication;
- A system to share and publish pieces of work;
- A system to publish offers, conferences, training opportunities, internships and exhibitions, among others:
- Showcase work and exhibitions;
- Communication channels between creative talents, artists, galleries, museums and sponsors, among others.
Preamble
These Terms and Conditions of Use constitute an agreement between: CECT - Consultora de Educación, Cultura y Tecnología Ltd, located at Rua Serpa Pinto, 14 A - 1º. 1200-445 Lisbon, Portugal, registered on the Lisbon Trade Register with VAT number 509003397 with a social capital of €5,000, hereafter "CECT"; and any user who wishes to register and use Th Art Boulevard portal – www.theartboulevard.org - hereinafter the “User”. Both parties agree that use of and registration on undertaken through this page – www.thearteboulevard.org - will be governed by this document.
Purpose
The herein General Terms and Conditions of Use & Privacy Policy aim to define and make available to the ‘User’ all the necessary information regarding the modes of use and different registration profiles, access and use of the The Art Boulevard webpage – www.theartboulevard.org
Registration
The Art Boulevard can be accessed by visiting www.theartboulevard.org. However, in order to access all of the services available on The Art Boulevard and maximize the user experience, the ‘User’ must register, following these steps:
a) Define user access data.
The ‘User’ must create an account and in order to do so, a user name and password must be chosen. This data is unique, personal and non-transferable.
b) Select the type of profile: Artist or Art Lover.
c) Provide the required information and choose from one of these options:
The Art Boulevard website offers two types of user profiles: Artist and Art Lover.
The user is responsable for the type of profile they choose.
○ If the ‘User’ chooses an Artists profiles, he or she must indicate:
o Full name;
o The art form in which he or she carries out their work: literatura, visual arts, music or any other type of artistic expression.
o Email
o User name and password.
○ If the ‘User’ selects an ‘Art Lovers’ profile, they must provide the following information:
o Name of the body/arts centre that they represent;
o Telephone number;
o Email;
o Brief description;
o Address (including city, country and postcode);
o User name and password.
During the registration process the ‘User’ must provide the personal details presented above and/ or choose from the different options available.
d) Accept the General Terms and Conditions of Use & Privacy Policy
The Registration process is complete when the following two actions have been carried out successfully:
- the ‘User’s’ email has been verified, by means of an automatically generated email sent to the email address provided;
- the ‘User’ accepts the here mentioned Terms and Conditions of Use and Privacy Policy.
Access
Every and each ‘User’ is subject to supervision and, in extreme cases, to the discontinuation of his or her access to restricted areas of the portal. Registration on The Art Boulevard permits one unique access for each combination of ‘User name and password’.
CECT reserves the right to deny any ‘User’ that misuses the webpage by publishing wrongful and inappropriate language on their profile page and on any other area of the site, sharing inappropriate and/or damaging content, transmitting unsuitable messages anywhere on the site, etc. access to the restricted areas of the portal.
Responsibility
The ‘User’ is solely responsible for the confidentiality of the user account data (username and password) assigned to them, granting them access to the restricted areas of The Art Boulevard. Therefore, the transfer of this data, be it temporary or permanent, it is strictly forbidden. CECT undertakes to ensure that all technical and legal efforts are made, in order to protect each and every user’s personal information.
Handling of Personal Information
As mentioned previously, when registering on the site, the ‘User’ is asked to provide some personal details. Depending on the profile type selected, this mandatory user information may include:
o‘User’ who has chosen to create an ‘Artist's’ profile:
o Complete name;
o Artistic Discipline he/she is working on: literature, visual arts, music, or any other discipline;
o Email;
o Username and password;
o‘User’ who has chosen to create an ‘Art Lover’s’ profile:
o Name of the body/arts centre that they represent;
o Telephone number;
o Email;
o Brief description;
o Address (including city, country and postcode);
o User name and password.
CECT will not disclose, nor sell to third parties, personal data provided by the ‘User’. CECT guarantees, as stated by the Data Protection Act (and other applicable regulations), the ‘User’s’ right to access, rectify and cancel at any given time, data held on file that directly corresponds to them. The right to access, rectification and cancellation can be exercised by sending an email to [email protected] or by letter to the following address: Rua Serpa Pinto, 14 A - 1º. 1200-445 Lisbon.
CECT reserves the right to analyse and use the data provided by the ‘User’ as a means to optimise the page, its content and functionalities, as well as personalising the user experience, without prejudice to the Data Protection Act.
Website maintenance and feature updates
CECT reserves the right to undertake maintenance and service updates on The Art Boulevard page in order to improve and optimise the functionalities offered as well as the user experience. Whenever the page undergoes maintenance or a service update, the ‘User’ will be notified by email.
Newsletter
Periodically, a newsletter will be sent to each ‘User’ that has expressly indicated their wish to receive it when registering on the site. The Newsletter will be sent to the ‘User’s’ email provided during the registration process. The ‘User’ may cancel their subscription to the newsletter by de-activating this option on their profile page or by clicking on the link at the bottom of the actual The Art Boulevard newsletter.
Use of community based areas of the site
All content and views expressed in the restricted areas of the site are the sole responsibility of the author. However, with the aim to ensure the proper functioning of these areas, all texts and messages will be subject to a moderation process, so as to eliminate and deny access to any ‘User’ who uses language considered obscene, discriminatory; threatening; sexist; xenophobic; libellous; insulting; or that affect the appearance or disabilities of any person or minority groups.
Intellectual Property – Creative Commons
With the exception of all extraordinary contracts or agreements, all of the content shared by users on The Art Boulevard portal (Text, photographs, designs, digital material, audio files etc.) will be protected under the Creative Commons license, “Attribution-NonCommercial-ShareAlike” which allows the work to be copied, distributed and redistributed, as well as derivative Works, under the terms described here:
- Attribution. You must attribute the work in the manner specified by the author or licensor (but not in any way that suggests that they endorse you or your use of the work).
- Noncommercial. You may not use this work for commercial purposes. It shares the same terms and licence. If you alter, transform, or build upon this work, you may distribute the resulting work only under the same or similar license to this one. For any reuse or distribution, you must make clear to others the license terms of this work.
Any of the above conditions can be waived with the permission from the copyright holder. Nothing in this licence impairs or restricts the author's moral rights. The user maintains the copyright of the shared material.
Articles or images copied from other web pages, books or magazines etc. are, under no exception, permitted, without prior authorisation from the author (or the copyright holder, in the event that these two are not the same person). Likewise, excerpts from articles are not permitted, nor the use of the start of a definition term copied from a dictionary without citing the source.
CECT reserves the right to take action, whether civil or criminal, in order to protect its legal intellectual property rights.
Upload and shared files
Any of the following file formats may be shared on the portal up to a maximum of 2MB:
· Audio files: mp3, WMa and Wav;
· Images: JPG, JPEG, PNG, GIF, BMP up to 2MB;
· Documents: PDF format.
The use of these files by third parties is subject to the licence chosen by the ‘User’.
Applicable law and relevant court
1. Use of The Art Boulevard webpage is regulated by Portuguese law.
2. Any conflict that arises as a result of a breach in these General Terms and Conditions of Use & Privacy Policy shall rest with the District Court of Lisbon.
Privacy Policy
In compliance and conformity with the Portuguese Law on Data Protection, all personal data provided by the ‘User’ will be subject to digital analysis and will be listed on CECT’s database(s). This data handling procedure is carried out with the following objectives:
○ Improve the services and functionalities of the page:
○ Optimise communication with the ‘User’;
○ Identify new opportunities for collaboration and establish partnerships.
All data is provided freely and in a forthcoming manner by the ‘User’. As stated by law, the ‘User’ has the right to access, correct, rectify and cancel any piece of personal data held, by sending an email to [email protected] or by letter to: Rua Serpa Pinto, 14 A - 1º. 1200-445 Lisbon.
The Art Boulevard webpage use cookies, which are transferred to the users computer, to help us improve navigation and the user’s experience.
Security
The Art Boulevard guarantees that all entries are protected and stored securely. CECT considers the confidentiality of the ‘User’s’ personal data of utmost importance and undertakes to make every necessary effort in order to maintain this confidentiality.
The ‘User’ hereby declares acknowledgement and acceptance of the aforementioned General Terms and Conditions of Use & Privacy Policy.
